That everyone signed below and individual or corporation, partnership or other form of business entity duly organized and existing under and by virtue of law (“Releasing Party”), for an in consideration of being allowed to participate in volunteer work and/or other activity on the HENRY & HELEN BIESENBACH PROPERTY, Wilson County, and for other good and valuable consideration, the sufficiency of which are hereby acknowledged and confessed by these presents does for himself, itself its successors and assigns, its heirs, executors and administrators, hereby REMISE, RELEASE and FOREVER DISCHARGE HENRY & HELEN BIESENBACH and Bob McWilliams )DBA, Texas Amateur Archeological Association; TAAA, its owners, employees, association members, all underwriters at interest, their successors and assigns, and their heirs, executors and administrators (“Released Parties”), of and from all claims, demand. debts and other liabilities, obligations, suits, damages, and cause or causes of action of any kind whatsoever, at law or in equity, known or unknown, arising before or after the date of this release, which Releasing Party now has or may have in the future, against the Released Parties, their successors and assigns, or their heirs, executors and administrators, arising directly or indirectly from participating in artifact hunting (digging or surface collecting), trail rides, hunting, fishing, recreational activity, or any activity on or about the HENRY & HELEN BIESENBACH PROPERTY , irrespective of whether such claims, demands, debts and other liabilities, obligations, suits, damages and cause or causes of action are due to the negligence, gross negligence, strict liability or other fault of Released Parties, or the concurrent negligence, gross negligence, strict liability or fault of Released Parties and any other person or entity.

The releasing party understands the risks involved with the use of heavy equipment (backhoe) around an artifact dig site. By signing this contract you are stating you are aware that you or any minor that is under your care at the site can be hurt or killed if hit by the equipment or falling tree limbs caused by the equipment or acts of God. Should a vehicle, tools or artifacts be damaged by the equipment, operator or employee of the TAAA (including dropping or running over an artifact and damaging it), the releasing party agrees not to hold the damaging party liable for the cost or replacement.

The Releasing Party expressly assumes full responsibility for all losses (including all stated above), damages, or claims for injury to his person and property and agrees to INDEMNIFY AND HOLD HARMLESS Released Parties from and against all claims, suits, or demands for property damages, or other monetary amounts including any attorney fees and court costs, made by Releasing Party, a person on behalf of Releasing Party, or any other person arising directly or indirectly from Releasing Party’s participation in artifact hunting (digging or surface collecting), trail rides, hunting, fishing, recreational activity, or any activity on or about the HENRY & HELEN BIESENBACH PROPERTY & the TAAA , irrespective of whether such claims, demands, debts and other liabilities, obligations, suits, damages and cause or causes of action are due to the negligence, gross negligence, strict liability or other fault of Released Parties, or the concurrent negligence, gross negligence, strict liability or fault of Released Parties and any other person or entity. Releasing Party AGREES THAT THIS AGREEMENT SHALL BE GOVERNED BY AND CONSTRUED UNDER THE LAWS OF THE STATE OF TEXAS AND VENUE SHALL LIE IN BEXAR COUNTY, TEXAS.
